Overview

TopCalls is a full-funnel AI-powered automation platform for legitimate business communications. This policy defines acceptable and prohibited uses of the platform.

Permitted Uses

TopCalls is designed for:

  • Business-to-Business (B2B) communications with established relationships or prior consent
  • Customer relationship management (CRM follow-up, appointment scheduling, surveys)
  • BPO operations automating communication workflows using the platform for contracted clients
  • AI-powered lead qualification and automated scheduling with opt-in contact lists
  • Customer support and service automation

Prohibited Uses

The following activities are strictly prohibited:

1. Unsolicited Marketing & Spam

  • Mass cold-calling to purchased lists without consent
  • Automated dialing to consumers in violation of TCPA or equivalent regulations
  • “Boiler room” operations or high-pressure sales tactics
  • Political campaigning or advocacy calling

2. Fraud & Deception

  • Misrepresenting caller identity or business purpose
  • Impersonation of government agencies, financial institutions, or other entities
  • Phishing, social engineering, or scam operations
  • False or misleading product/service claims

3. Illegal Content & Services

  • Promotion of illegal products or services
  • Intellectual property infringement
  • Violation of sanctions, export controls, or money laundering regulations

4. Regulatory Non-Compliance

  • Calling numbers on Do Not Call (DNC) registries without proper exemption
  • Failing to honor opt-out requests
  • Operating without required business communication licenses or registrations
  • Violating GDPR, TCPA, TSR, or equivalent data protection laws

5. Platform Abuse

  • Circumventing rate limits, security controls, or usage restrictions
  • Attempting to reverse-engineer or extract proprietary models
  • Reselling platform access without authorization

Client Responsibilities

Compliance Obligations

Clients are responsible for:

  • Obtaining all required consents and permissions for contacts
  • Maintaining internal Do Not Call (DNC) lists and honoring opt-outs
  • Complying with TCPA, TSR, GDPR, and all applicable regulations
  • Ensuring team members understand acceptable use and compliance requirements
  • Monitoring AI output quality and ensuring proper platform configuration

Contractual Safeguards

All TopCalls clients operate under individual service agreements requiring:

  • Representation of legal authority to use provided contact data
  • Indemnification for misuse or regulatory violations
  • Immediate termination rights for policy violations

Enforcement

Monitoring & Audits

TopCalls reserves the right to:

  • Monitor usage patterns for policy compliance
  • Request documentation of consent and compliance measures
  • Suspend or terminate accounts with suspected violations

Violation Response

Policy violations may result in:

  • Warning – First-time minor violations with immediate corrective action
  • Suspension – Temporary account suspension pending investigation
  • Termination – Permanent account closure for serious or repeat violations
  • Legal Action – Referral to authorities for illegal activity

Dispute Resolution

Clients may appeal enforcement actions by contacting hello@topcalls.ai with supporting documentation.

Updates to This Policy

TopCalls may update this policy as regulations or business practices evolve. Material changes will be communicated via email with 30 days' notice.
